1. General
1.1 These Terms & Conditions (“T&Cs”) apply to all contracts between NERVIDA / Johanna Kappel (“we”, “us”) and private female clients aged 18+ (“you”, “the customer”), including future contracts, regardless of whether reference to these T&Cs is made in the future.
1.2 By using our services, including online and offline classes, workshops, programs, memberships, bundles, or other products, you agree to these T&Cs.
1.3 Any differing terms from the customer, including amendments, require our prior written consent to be valid.
2. Services
2.1 Services include online and offline classes, workshops,programs, training sessions, pre-recorded content, audio/video materials, memberships, and bundles.
2.2 All services are provided “as is” and may vary in schedule, duration, or format. We reserve the right to change dates, times, and delivery methods in exceptional circumstances.
2.3 Offline events are individually tailored: details, dates, and locations may vary and are specified in the booking confirmation.
3. Prices & Payment
3.1 Pricing is displayed per product on the website and may vary (e.g., 1:1 Training €99/per session, Membership €55/month, Master Class €33, Mini Class €22, Bundles / pre-recorded programs as advertised).
3.2 We accept payment via: Bank Transfer, Credit Card, PayPal, Stripe, Klarna, or other options specified per product.
3.3 All prices are final; as a small business under Austrian law (§ 6 Abs 1 Z 27 UStG), VAT is not charged.
3.4 Rate payments may be offered; conditions are specified per product at checkout.
3.5 All payments must be completed as specified; no refunds are issued except as required by law or explicitly stated in product conditions.
4. Access & Membership
4.1 Online memberships, live classes, programs, and bundles remain accessible as long as your membership or purchase is valid.
4.2 Membership schedules are weekly; live classes may only be accessed on their scheduled day.
4.3 Pre-recorded content is available according to the terms of the purchased package.
4.4 All content is for personal use only; sharing, distribution, or resale is strictly prohibited.
5. Cancellation & Refund Policy
5.1 No cancellation or refund is generally provided for Memberships, Master Classes, Programs, Mini Classes, Bundles, or Offline Events.
5.2 Exceptions are only as required by applicable consumer protection law.
5.3 A separate Cancellation / Withdrawal Policy outlines legal rights for consumers, including special rules for instant-access digital content.
6. Customer Obligations & Safety
6.1 You confirm that you are physically, emotionally and mentally able to participate in our services.
6.2 For online classes, you are responsible for a safe, quiet, and unobstructed space, sufficient room, and a stable internet connection.
6.3 For offline & online events, participants may be photographed or recorded; consent is obtained during registration.
6.4 You are responsible for your own safety and health during all activities.
7. Liability
7.1 We are not liable for injuries, accidents, or other incidents during online or offline participation, except in cases of intentional misconduct or gross negligence.
7.2 We are not liable for indirect damages, lost profits, or consequential damages.
7.3 We do not guarantee specific results from participation in classes, workshops, or mental training.
7.4 We are not liable for technical problems with Zoom, YouTube, WordPress, WooCommerce, or other platforms used to deliver services.
8. Intellectual Property
8.1 All content, scripts, materials, and digital assets provided by us remain our intellectual property.
8.2 Use, copying, sharing, distribution, or publication without written consent is prohibited.
9. International Participation
9.1 Services are available to adult women (18+) worldwide.
9.2 Local consumer laws may apply; international participants agree that Austrian law governs the contract.
9.3 Disputes are subject to the jurisdiction of Salzburg, Austria.
10. Coupons, Discounts, Promotions
10.1 Coupons are personal, non-transferable, and valid for 1 year unless otherwise specified.
10.2 Discounts and promotions are applied as advertised and cannot be combined unless explicitly stated.
11. Privacy & Cookies
11.1 Use of our website and services requires acceptance of our Privacy Policy, which covers data collection, processing, and cookies.
11.2 Non-essential cookies require user consent; you may withdraw consent at any time.
12. Modifications & Interruptions
12.1 We reserve the right to cancel, postpone, or reschedule classes, workshops, programs or events in exceptional circumstances.
12.2 Missed online sessions will be rescheduled whenever possible, but no refunds are given.
13. Severability
13.1 If any provision is invalid, the remaining provisions remain in force.
13.2 Parties shall replace invalid provisions with valid ones that achieve the intended economic effect.
14. Governing Law & Jurisdiction
14.1 Austrian law applies, excluding UN Sales Law and conflict-of-law rules.
14.2 Place of performance and jurisdiction: Salzburg, Austria.
14.3 Written form is required for any amendments; verbal agreements do not exist.
